Declaration
I, [DECLARANT NAME], declare under penalty of perjury under the laws of the United States of America, pursuant to 28 U.S.C. § 1746, that the following is true and correct:
1. Identity and Capacity. I am the [TITLE - e.g., Records Custodian, Director of Compliance] of JIL Sovereign Technologies, Inc., a Delaware corporation (the "Company"). I am over the age of eighteen and am competent to testify to the matters set forth herein. I make this Declaration based on my personal knowledge of the Company's record-keeping practices and on my review of the records described below.
2. Records Identified. Attached hereto as Exhibit A are true and accurate copies of the following records produced by the Company in the ordinary course of its business (the "Records"):
- [DESCRIBE EACH RECORD], identified by JIL CREB™ Bundle ID [UUID] and Layer 1 audit anchor SHA-256 [HEX HASH], dated [DATE].
3. Compliance with Federal Rule of Evidence 902(11). The Records are records of regularly conducted activity that satisfy Federal Rule of Evidence 803(6)(A) through (C). Specifically:
- The Records were made at or near the time of the events recorded by, or from information transmitted by, persons or systems with knowledge of the matters recorded;
- The Records were kept in the ordinary course of the Company's regularly conducted business activity, namely the operation of the Company's payment-integrity and adversarial-validation platform, including the AVA™ Pro and AVA™ Pro+ analytical pipelines and the production of Court Ready Evidence Bundles ("CREBs"); and
- Making such records is a regular practice of the Company's regularly conducted business activity, and is required for the Company's contractual and regulatory obligations to its customers.
4. Compliance with Federal Rule of Evidence 902(14). Each Record is data copied from an electronic device, storage medium, or electronic file that is authenticated by a process of digital identification, as shown by the following:
- At the moment each Record was created, the Company computed a SHA-256 cryptographic hash of the Record's binary content. The SHA-256 hash for each Record is set forth in Exhibit B.
- Each SHA-256 hash was, contemporaneous with creation, written to the Company's Layer 1 audit ledger ("CourtChain™"), an append-only distributed ledger operated by the Company across multiple jurisdictionally separated nodes. The CourtChain™ anchor block hash and block height for each Record are set forth in Exhibit B.
- Records are stored in Amazon Web Services Simple Storage Service buckets configured with Object Lock in Compliance Mode, which prevents deletion or modification of the stored object for the duration of the retention period (set to fifteen (15) years for the Records). This configuration is enforced by Amazon Web Services and may not be overridden by the Company's account, including by use of root credentials.
- The integrity of the Records may be verified at any time by recomputing the SHA-256 hash of the produced binary and comparing to the contemporaneous anchor recorded on CourtChain™. Any tampering with a Record after creation would yield a different SHA-256 hash and would be detectable.
5. Notice to Adverse Party. Pursuant to Federal Rule of Evidence 902(11) and 902(14), reasonable written notice of the intent to offer the Records and this Declaration was given to the adverse party on [DATE OF NOTICE], a true and accurate copy of which is attached as Exhibit C.
6. Custody and Control. The Company maintains custody of the production-environment originals of each Record and is the custodian of the chain-of-custody records for each Record. The chain-of-custody record for each Record is summarized in Exhibit D.
7. No Material Alteration. The Records have not been altered or modified since the time of their creation, except for the redaction of personally identifying information not relevant to the issues in this matter, which redactions are clearly marked and were made by [NAME] on [DATE] in the ordinary course.
