Retroactive Verification - business pack
Court-ready CREB™ bundles for fraud recovery, FCA litigation, regulatory inquiry, and counterparty disputes. Per-bundle pricing. Live and shipping today.
What Retroactive Settlement Verification is - in one paragraph.
Retroactive Verification is the per-case evidence-bundle product. DOJ Civil Frauds, HHS-OIG, state MFCUs, and FCA relator's counsel buy it to convert their existing case theory into a signed, reproducible CREB™ bundle. Pricing is set against the measurable value the bundles recover and protect for the customer, measured first by an exposure assessment.
Three things to nail in every conversation
Per-case, not per-seat
Delivered per case and priced against the value it returns. No annual subscription minimum. Customers buy what they need, when they need it.
Federal-court grade
Designed for FRE 902(14) self-authentication. Court-appointed expert can verify the chain of custody from the bundle itself, with a written certification comparing hash values in place of live JIL testimony at trial. We have no data on state MFCU practice and make no claim about it.
Methodology + data + signature in one
CREB™ carries the deterministic methodology, the public-data row that fired each rule, the threshold, and the reasoning chain. Reproducible by any analyst with the data.

Pricing principles + SLA financial backing
Pricing is set against the measurable value the work recovers and protects for the customer. An exposure assessment measures it first, and ROI is that value divided by the fee. There is no rate card and no flat per-bundle price, and it is not a contingency fee: the customer keeps 100% of recoveries. No annual minimum. The SLA tiers below set delivery speed and financial backing for accuracy claims, on the same structure as Pre-Clearance. They are service levels, not price points. See pricing principles.
| SLA tier | Uptime SLA | Latency SLA | Backing cap | Buyer profile |
|---|---|---|---|---|
| Tier A - Standard CREB™ | 99.9% | 5-10 day delivery | $50K accuracy claim cap | First-time + low-volume buyers |
| Tier B - Institutional CREB™ | Per contract | 3-7 day delivery | $250K accuracy claim cap; up to $5M / yr aggregate | MCOs + DOJ + recurring-engagement customers (50+ bundles / yr) |
| Tier C - Premium CREB™ | 99.99% | 2-4 day delivery | $500K accuracy cap; $25M / yr aggregate | Top-volume customers (500+ bundles / yr); DOJ Main + national MFCU consortium |
Add-ons + line items
Expert witness retention
If a customer needs a JIL-trained expert to testify, retention is scoped and quoted in the engagement. Most cases don't need this (the CREB™ is self-authenticating).
Custom data-source integration
If a customer needs a private data source ingested into the methodology (e.g., proprietary loss-run + public CMS data), per-source engineering fee billed upfront.
Same-day rush
Tier A or B with same-day delivery, quoted in the engagement. Subject to engineering capacity.
Annual commitment (Tier C service level)
Customers committing to 500+ bundles annually hold the Tier C delivery and backing levels for the year regardless of actual volume.
What to say to whom
Buying committees are rarely one person. Use the right framing per role.
| Role | What they care about | Lead with | Don't say |
|---|---|---|---|
| DOJ AUSA / Civil Frauds | Self-authenticating evidence; expert witness avoidance; FRE 902(14) admissibility | "FRE 902(14) self-authenticating CREB™. Court-appointed expert verifies the cryptographic chain - no JIL fact witness needed at trial." | Don't promise we'll testify; promise we won't have to |
| HHS-OIG analyst / SAC | Public-data first-pass triage; reproducible methodology; per-finding evidence | "Public CMS + Medicaid TAF + USAspending findings, pre-ranked, with deterministic methodology + thresholds inside the CREB™." | Don't position as replacing the analyst; we accelerate the first pass |
| State MFCU director | Referral-package format; investigator workflow alignment; budget per case | "Per-referral CREB™ matches typical state MFCU intake. Reduces back-and-forth on methodology + provenance. Investigators see signed evidence + reproducible analysis day one." | Don't pitch as fraud-detection replacement; we feed their pipeline |
| FCA relator's counsel (qui tam) | Case-prep cost; complaint-credibility substrate; per-case predictability | "The exposure assessment shows the case-prep economics before the work starts. CREB™ is the evidentiary substrate that helps your relator's counsel build a credible complaint." | JIL is not a relator; we don't file qui tam complaints |
| MCO SIU director | Case throughput; outside counsel hand-off quality; per-case cost vs. in-house investigator | "Per-bundle replaces per-investigator-hour billing. Same evidence package serves both your in-house SIU and your outside FCA counsel." | Don't promise to find fraud they don't already suspect; we work from their case theory |
Close patterns
["Show me one": /samples/verdict-record-retroactive-verification.] ["What's a CREB™ look like to a court": route to the FRE 902(14) framework on /verify.] ["How fast": Tier A 5-10 days; Tier B 3-7; Tier C 2-4.]
What blocks deals - and how we handle it
Be honest about what we don't have. The buyer respects it more than dodging.
| # | Objection | What we have | What we don't | How to handle |
|---|---|---|---|---|
| 1 | Per-case cost vs. in-house workup | The exposure assessment measures recoverable value before terms are set, so the return is visible up front | For very small cases (<$50K recovery), a single bundle may not return its cost | Recommend an annual commitment across the case portfolio; for tiny cases, suggest customer use sandbox + bundle internally |
| 2 | Court hasn't seen FRE 902(14) crypto evidence yet (in our jurisdiction) | FRE 902(14) has been in the Rules since 2017, and certification plus hash comparison is exactly what it was written for | No reported decision on a JIL bundle. We have no cases on file and we do not claim any | Say plainly that there is no decision to cite. Offer a pre-trial stipulation on authenticity and hand counsel a sample certification to review in advance. Admissibility is their call to argue, not ours to opine on |
| 3 | Customer's existing investigator network resists vendor disruption | JIL CREB™ is the substrate; investigators still do interpretation + recommendation | Some investigators see this as displacement | Position as 'helps your investigators ship more cases per quarter' - it's a productivity story, not a replacement |
| 4 | Public-data accuracy / provenance challenges | Per-CREB™ methodology + threshold + data row + reasoning chain; reproducible | Public data has known errors | We don't claim the public data is correct; we claim the methodology applied to it is reproducible. CREB™ makes this explicit. |
| 5 | Statute of limitations + admissibility timing | Retroactive analysis + CREB™ delivered 2-10 days; well within typical SOL windows | If customer brings us in 30 days before SOL expiry, we can't help | Lead with: bring us in early in case-development, not at SOL deadline |
Legal posture - in lawyer-friendly bullets
For the buyer's GC + CCO + outside counsel. Send this section verbatim ahead of the legal call.
Service provider, not legal counsel
JIL produces signed evidence + reproducible methodology. The legal strategy + the recovery action stay with the customer's counsel. JIL does not provide legal advice.
FRE 902(14) self-authentication
Every CREB™ is designed to satisfy FRE 902(14) for self-authenticating electronic records. Cryptographic signature + CourtChain anchor + independent cryptographic signing makes it verifiable by court-appointed expert without JIL fact witness.
Standard professional-services MSA
Per-bundle engagements use a JIL Professional Services MSA + per-engagement Statement of Work. Standard SaaS-style; no special licensing required.
Source-data provenance
Each CREB™ itemizes its source data (URL, dataset version, pulled-at timestamp, sha256). Customer's auditor can trace any finding back to the public data row that fired the rule.
Non-relator status
JIL is NOT an FCA relator and does not file qui tam complaints. We produce evidence; the customer's counsel files.
Confidentiality
Customer-specific case work is confidential. JIL does not disclose customer engagement existence, content, or outcomes without customer written consent. Customer can require source-data isolation in dedicated AWS account on Tier B+.
